1. Agreement to Terms

By accessing or using Bin N Out services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

2. Service Description

Bin N Out provides professional waste management services including:

• Twice weekly bin takeout and retrieval service
• Monthly professional bin cleaning and sanitization
• Service for up to 2 bins per trip
• Service area: Naples, FL (currently exclusive to The Isles Of Collier Preserve)

3. Subscription and Payment

3.1 Subscription Plans: Services are provided on a monthly subscription basis. Subscription fees are charged monthly in advance.

3.2 Payment: Payment is processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis.

3.3 Price Changes: We reserve the right to modify subscription prices. You will be notified at least 30 days in advance of any price changes.

3.4 Refunds: Refunds are provided on a case-by-case basis. Service fees for the current month are non-refundable once services have been rendered.

4. Cancellation Policy

4.1 Cancellation by Customer: You may cancel your subscription at any time through your account dashboard or by contacting support at support@bin-n-out.com. Cancellation will take effect at the end of your current billing period.

4.2 Cancellation by Bin N Out: We reserve the right to suspend or cancel your subscription for violation of these terms, non-payment, or any other reason at our discretion.

5. Customer Responsibilities

You agree to:

• Provide accurate and complete information during registration
• Ensure bins are accessible and properly positioned for service
• Notify us of any changes to your address, bin location, or access codes
• Ensure bins are not overloaded or contain prohibited materials
• Maintain a valid payment method on file
• Comply with all local waste management regulations

6. Service Limitations

6.1 Weather Conditions: Services may be delayed or canceled due to severe weather conditions, natural disasters, or other circumstances beyond our control.

6.2 Access Issues: We are not responsible for service delays due to inaccessible bins, locked gates, or other access restrictions.

6.3 Bin Condition: We reserve the right to refuse service for bins that are damaged, unsafe, or contain prohibited materials.

7. Limitation of Liability

To the maximum extent permitted by law, Bin N Out shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

8. Indemnification

You agree to indemnify and hold harmless Bin N Out, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of our services or violation of these terms.

9. Privacy

Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs your use of the services, to understand our practices.

10. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of any material changes by posting the new Terms of Service on this page and updating the "Last updated" date. Your continued use of our services after such modifications constitutes your acceptance of the updated terms.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
